A dealer has offered to sell us an EV at a good price, telling us the BAFA discount has been applied, and that's why the price is low. They took possession of it in August 2023, registered it in their dealership name, and then applied for and got the BAFA subsidy. Now it's for sale via mobile.de. They say, however, that the 'minimum holding period' (Mindesthaltedauer) is now 1 year, so the registration must remain in their name until Aug 2024 (if the vehicle was re-registered in our name, the BAFA subsidy would have to be paid back). They say they can/will sell it to us, as it's fine to transfer ownership, and we can drive it away, but they will maintain the registration in their name until August, then we can switch it to us.
Is this legit?

No problem with that. We had to leave the registration with the dealer for our EV for 6 months.
You just have to be sure and get the insurance sorted.
