I agree but until we know the facts and types of income it is not possible give more than generic advice.

Re: becoming a UK non resident for tax matters
Why are you employing a UK accountant to sort out your tax when you are tax resident in Germany? Subject to the double taxation agreement giving taxing rights to the UK, e.g. if you have UK property rental income, all of your income is taxable in Germany, and even items like rental income that are n...

Re: becoming a UK non resident for tax matters
Why do you consider that you are still tax resident in the UK and that, presumably, you are not tax resident in Germany. As a general matter of tax law, Germany has had the right to tax your worldwide income since you arrived and registered. The UK may also have the right to tax income arising in th...

Re: confusion over german inheritance
Being estranged and/or having power of attorney has nothing to do with anything and I would suggest following the court's ruling and not giving an inch in terms of finalising the estate. Anything else would seem like opening an unpleasant can or worms! If your wife then decides to gift her aunt some...

Re: I don't want to qualify for a German pension...
But if you call or use the code online to claim your pension that is not a question. They may then send you a form CF901 to complete to enable DWP to start the claim process for you in Germany or wherever but if you don't send that form back then they won't chase you for it.

Re: I don't want to qualify for a German pension...
I know it is the case in reverse, that is if you apply in Germany, DRV will automatically apply for you in other countries you have contributed in. Only if you tell them about these contributions in the other countries... I agree. You have to claim a pension - it's not something that just lands in ...

Re: UK Pension Winter Fuel Payment and bonuses
Just back from holiday and a bit jet-laggy and tired but thought I would add a few thoughts. Under UK tax law you are required to notify HMRC of any new source of income but are only required to submit a self-assessment tax return if you receive a "Notice to complete a tax return" from HMR...

Re: UK general election 2024, who to vote for?
Politics is complicated and very personal but as a UK resident I think we need a change of party as the current government has, in my view, run into the buffers and the party itself is fracturing as extremism takes hold. They are riddled with scandal to such an extent that their 2019 majority has be...

Re: UK Inheritance and the German Finanzamt
Up to you but as I said, "ignorance of the law is not a valid excuse" and has been upheld in judicial dicta across many, many, tax cases that have landed in the courts.

Re: UK Inheritance and the German Finanzamt
you do not have to use the Scheme unless you’re told to do so by HMRC. This is the key point! ;) Sorry but you need to read the whole sentence/paragraph, not just cherry-pick a few words that you think support your case. And if you think the text is ambiguous, it would be incumbent on you to acquai...

Re: UK Inheritance and the German Finanzamt
Thank you, Gary. The whole think is mind-boggling from a German tax perspective. For example, just take the German "Fußstapfentheorie", which means that under German rules, you also get gifted/inherit the original purchase price and purchase date of an asset (be it a house or a batch of s...

PandaMunich is correct. If you are a non-resident UK landlord then you fall under the "Non-resident Landlords Scheme" - https://www.gov.uk/government/publications/non-resident-landord-guidance-notes-for-letting-agents-and-tenants-non-resident-landlords-scheme-guidance-notes/what-the-non-re...

Re: UK Inheritance and the German Finanzamt
Sorry but income from immovable property, aka rental income is taxable in the UK under the double tax agreement AND feeds into Progressionsvorbehalt on your German tax return, thus increasing your German tax rate.

Re: UK Inheritance and the German Finanzamt
Inheritance Tax is hideously complicated once you step out of the norm, i.e. once you try too avoid it, not to mention the juxtaposition with Capital Gains Tax, Income Tax and Stamp Duty Land Tax. What follows is stretching my knowledge but here's a starter for ten... The starting point for IHT is t...

Re: UK Inheritance and the German Finanzamt
I’m not trying to avoid inheritance tax but would like to know if the German Finanzamt will even find out that the house was partially in my name before it was reinstated as part of the inheritance. Financially I don’t think it makes any difference but I just don’t want to make the tax return next ...

Re: Taxing States
Regarding depreciation, now I am drifting away, the only downside of the German way is the 50 years of stretch. Still better than the UK way, which doesn't allow any depreciation: https://www.ingletonpartners.com/insights/rental-income-and-mortgage-interest-deduction/ I guess that’s because British...

And here is a link to all you need to know about paying https://www.gov.uk/paying-inheritance-tax. But remember the "you" here is not "you" as a beneficiary who has their own bank account but "you" as the Executor, who has a bank account for the purpose of administering...
